{"id":2600,"date":"2021-05-18T15:51:00","date_gmt":"2021-05-18T15:51:00","guid":{"rendered":"https:\/\/apexsamplework.com\/insightnews\/?p=2600"},"modified":"2025-04-29T15:52:55","modified_gmt":"2025-04-29T15:52:55","slug":"the-racist-past-of-the-filibuster-and-why-it-should-end-now","status":"publish","type":"post","link":"https:\/\/apexsamplework.com\/insightnews\/2021\/05\/18\/the-racist-past-of-the-filibuster-and-why-it-should-end-now\/","title":{"rendered":"The Racist Past of the Filibuster and Why it Should End Now"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The&nbsp;<a href=\"https:\/\/blackpressusa.com\/house-of-representatives-passes-george-floyd-justice-in-policing-act\/\" rel=\"noreferrer noopener\" target=\"_blank\">George Floyd Justice in Policing Act<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/blackpressusa.com\/u-s-house-of-representatives-passes-milestone-voting-and-ethics-legislation\/\" rel=\"noreferrer noopener\" target=\"_blank\">a voting and ethics bill<\/a>&nbsp;passed the Democratic-controlled U.S. House of Representatives, but neither stands a chance in the evenly divided Senate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">President Joe Biden\u2019s $1.9 trillion&nbsp;<a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/legislation\/2021\/01\/20\/president-biden-announces-american-rescue-plan\/\" rel=\"noreferrer noopener\" target=\"_blank\">American Rescue Plan<\/a>&nbsp;faced fierce opposition in the Senate, but ultimately a slimmed-down version passed using the&nbsp;<a href=\"https:\/\/budget.house.gov\/publications\/fact-sheet\/budget-reconciliation-basics\" rel=\"noreferrer noopener\" target=\"_blank\">reconciliation procedure<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Reconciliation is used only in rare cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lawmakers cannot use it for the George Floyd Justice in Policing Act,&nbsp;the voting rights and ethics measure,&nbsp;<a href=\"https:\/\/blackpressusa.com\/?s=DC+Statehood\" rel=\"noreferrer noopener\" target=\"_blank\">D.C. Statehood<\/a>, and other causes near and dear to some Democrats and most African Americans.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But Democrats do have a rare opportunity to get rid of the&nbsp;<a href=\"https:\/\/www.brookings.edu\/policy2020\/votervital\/what-is-the-senate-filibuster-and-what-would-it-take-to-eliminate-it\/\" rel=\"noreferrer noopener\" target=\"_blank\">filibuster, a Senate cloture rule requiring 60 members to end debate on a topic and move to a vote.<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NNPA Newswire has reached out to all 50 Senate Democrats and Independents seeking their position on the filibuster.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While some responded, others have held their positions close to the vest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIf we want to get things done in the Senate, then we must abolish the filibuster,\u201d declared Sen. Ed Markey (D-Mass.).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt is an antiquated, Jim Crow rule that overrides the majority and halts progress. It\u2019s got to go.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nora Keefe, a spokesperson for Sen. Elizabeth Warren (D-Mass.), told NNPA Newswire in an email that Warren \u201cis a long supporter of getting rid of the filibuster.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sen. Warren tweeted that the&nbsp;<a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/house-bill\/1\/text\" rel=\"noreferrer noopener\" target=\"_blank\">\u2018For The People Act\u2019<\/a>&nbsp;includes critical parts of her bill to end corruption.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt\u2019s a good first step for protecting voting rights and restoring trust in our government,\u201d Sen. Warren noted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe can\u2019t let [Sen. Minority Leader] Mitch McConnell (R-Kentucky) veto this critical bill for our democracy with the filibuster. If the Senate is going to do the things the American people expect us to do, we must abolish the filibuster.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sen. Tina Smith (D-Minn.) voiced support for ending the filibuster.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe Senate needs to abolish the filibuster,\u201d Sen. Smith tweeted over the weekend.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt\u2019s undemocratic, and we need to move this country forward.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Noting that any significant voting rights legislation would need unlikely Republican support, Sen. Amy Klobuchar (D-Minn.) admitted she had changed course on the filibuster.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI\u2019ve gone from a \u2018maybe\u2019 to a \u2018yes,\u2019\u201d Klobuchar said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sen. John Tester (D-Montana) also is reportedly leaning toward approving any attempts to end the filibuster while Sen. Jeff Merkley (D-Oregon) remains a \u201cyes.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Democrats Joe Manchin of West Virginia and Kyrsten Sinema of Arizona both have opposed efforts to eliminate the filibuster.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, after the marathon session to pass President Biden\u2019s American Rescue Plan, Sen. Machin hedged slightly in a nationally televised interview with&nbsp;<a href=\"https:\/\/www.nbcnews.com\/meet-the-press\/video\/manchin-i-m-not-going-to-change-my-mind-on-the-filibuster-102228549623\" rel=\"noreferrer noopener\" target=\"_blank\">NBC News<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI\u2019m not going to change my mind,\u201d he insisted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sen. Manchin noted he would support establishing a \u201ctalking filibuster\u201d that might require any senator objecting to ending debate to remain on the floor and speak for the entire time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIf you want to make it a little bit more painful, make him stand there and talk, I\u2019m willing to look at any way we can,\u201d Sen. Manchin remarked. \u201cBut I\u2019m not willing to take away the involvement of the minority.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">President Joe Biden has refused to publicly discuss whether he would seek an end to the filibuster.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.vermontlaw.edu\/directory\/person\/carter-jared\" rel=\"noreferrer noopener\" target=\"_blank\">Professor Jared Carter, a Constitutional Law Expert at Vermont Law School<\/a>, said it\u2019s time to end the filibuster.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He noted that the first filibuster occurred in 1837 and was used infrequently until after the Civil War when minority parties employed the measure to stop civil rights efforts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt is a relic of reconstruction and Jim Crow South. It was regularly used to oppress racial minorities and oppose civil rights laws,\u201d Professor Carter wrote in an email to NNPA Newswire.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cLast year, Sen. Rand Paul (R-Kentucky) threatened a filibuster over an anti-lynching law,\u201d Professor Carter noted. \u201cIt\u2019s anti-democratic in that it gives the minority party veto power over popular legislation.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rashad Robinson, the president of&nbsp;<a href=\"https:\/\/colorofchange.org\/\" rel=\"noreferrer noopener\" target=\"_blank\">Color of Change<\/a>, noted the filibuster has always stood in the way of racial progress.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhether employed by Southern Democrats of the Jim Crow era or the Republican Party today after a major shift in the party\u2019s stance on racial equality,\u201d Robinson wrote in an&nbsp;<a href=\"https:\/\/www.usatoday.com\/story\/opinion\/2021\/03\/01\/end-filibuster-make-progress-race-voting-guns-health-care-column\/6779720002\/\" rel=\"noreferrer noopener\" target=\"_blank\">op-ed for USA Today<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhen you understand the filibuster\u2019s racist past, it becomes clear that it has a racist present as well \u2014 and that we need to get rid of it.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">His argument is as sound as any and dates well beyond Jim Crow.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In&nbsp;<a href=\"https:\/\/www.naacp.org\/naacp-history-dyer-anti-lynching-bill\/\" rel=\"noreferrer noopener\" target=\"_blank\">1922 the House passed<\/a>&nbsp;a vital anti-lynching bill to combat the Ku Klux Klan\u2019s worst violence, but it was filibustered in the Senate by&nbsp;<a href=\"https:\/\/scalar.usc.edu\/nehvectors\/stakeman\/dyer-anti-lynching-bill\" rel=\"noreferrer noopener\" target=\"_blank\">southern Senate Democrats<\/a>, Robinson noted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Congress tried again in 1935, but Georgia Democrat Richard Russell&nbsp;<a href=\"https:\/\/www.wnycstudios.org\/podcasts\/takeaway\/segments\/racist-filibuster-we-cant-afford-forget\" rel=\"noreferrer noopener\" target=\"_blank\">organized a six-day filibuster<\/a>&nbsp;to oppose it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Russell once said he was \u201cwilling to go as far and make as great a sacrifice to preserve and ensure white supremacy in the social, economic, and political life of our state as any man who lives within her borders.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As Robinson wrote, the Senate\u2019s grandest office building is now named in Russell\u2019s honor, and Congress has never \u2013 to this day \u2013 passed an anti-lynching bill.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lawmakers used the filibuster attempting to stop the 1957 Civil Rights Act, and, most recently, Republicans have asserted it in attempts to thwart the DREAM Act, the Affordable Care Act, and other bills that benefit communities of color.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Many have posed the question similar to&nbsp;<a href=\"https:\/\/www.nytimes.com\/2021\/03\/05\/briefing\/cuomo-nursing-homes-harry-meghan-interview-stimulus-bill.html\" rel=\"noreferrer noopener\" target=\"_blank\">David Leonhardt of the New York Times, who asked, \u201cif forced to choose between the protection of voting rights and the protection of the filibuster, what will Democrats do?\u201d<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Leonhardt characterized his position by declaring that \u201cit\u2019s shaping up to be the most significant question about the new Democratic Senate.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He noted that Republican legislators in states throughout the nation are on a mission to make voting more difficult because they believe that lower turnout helps the party win elections.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court \u2013 with six Republican appointees among the nine justices \u2013 has generally allowed voter restriction laws to stand.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe filibuster hurts all of us, not just the Black community,\u201d Robinson, of Color of Change, noted. \u201cAnyone who needs real change or help loses out to the Republican obsession with power.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Leonhardt concluded that \u201cthere does not appear to be a compromise path on this issue. Democrats can overhaul the filibuster \u2014 and, by extension,&nbsp;<a href=\"https:\/\/www.nytimes.com\/2021\/01\/27\/briefing\/vaccines-trump-impeachment-trial-hong-kong.html\" rel=\"noreferrer noopener\" target=\"_blank\">transform the Senate<\/a>, ushering in an uncertain era in which both parties would be able to pass more of the legislation they favor. Or Democrats can effectively surrender on voting rights.
